Acceptance of Terms

Welcome to AmphorApp. By creating an account, purchasing a plan, accessing or using the website, iOS app, PWA, APIs or any platform feature, you declare that you have read, understood and fully accepted these Terms of Use and the Privacy Policy.

If you do not agree with any provision, do not use the Platform.

Definitions

For the purposes of these Terms:

• AmphorApp: digital platform for wine intelligence, cellar asset management, curation, education, gamification and personalized recommendations.
• User: individual or legal entity registered on the Platform.
• User Content: information, images, ratings, inventories, tasting records, cellar data, leagues and other materials submitted by the user.
• Codex Vinorum: editorial database on wines, terroirs, grape varieties, producers and educational content.
• WineCards / WineWinner: proprietary systems for cards, leagues, rankings and educational games.

Scope and features

AmphorApp offers, among others, the following features:

• Cellar, vault and wine & beverage collection management and inventory.
• Label scanner via camera and product recognition.
• Grape varieties, terroirs, producers, regions and wine catalog lookup.
• Sensory profile (“Palate DNA”), food pairing and AI-powered recommendations.
• Experiences, tastings, confraternities, leagues and communities.
• WineCards, WineWinner and Codex Vinorum editorial content.
• Asset indicators and collection tracking.

Eligibility

You declare that you have legal capacity to contract and are at least 18 years old.

Minors may only use the Platform with authorization and supervision of legal guardians.

AmphorApp does not sell alcoholic beverages to minors and does not encourage irresponsible consumption.

Age rating and legal alcohol compliance

AmphorApp is an informational and educational wine platform. It references alcoholic beverages frequently in catalog, terroir, scanner and educational content. For that reason, store age ratings on Apple App Store and Google Play may classify the app as 17+ or 18+ (or Mature) depending on territory.

This classification reflects wine culture and education content. It is separate from Apple’s “Parental Controls” and “Age Assurance” product categories under In-App Controls — AmphorApp does not implement those Apple parental-control features.

AmphorApp enforces the legal minimum age to purchase or consume alcoholic beverages according to the user’s country of residence, not a single global age.

• Minimum age 21: United States and other jurisdictions where local law requires 21.
• Minimum age 20: Japan and other jurisdictions where local law requires 20.
• Minimum age 19: Canada, South Korea, New Zealand and other jurisdictions where local law requires 19.
• Minimum age 18: Brazil, Portugal, Germany, France, Italy, Spain, Argentina, Chile, Mexico, United Kingdom and most other supported countries.

At native sign-up on iOS and Android, country of residence and date of birth are required. On the website and in the apps, server-side checks (RegionalAlcoholAge / AlcoholAgeGate) block access until the user meets the legal minimum age for the selected country. Accounts that do not meet the requirement cannot be created or must complete age verification in Profile.

AmphorApp does not sell alcoholic beverages, does not deliver alcohol and does not encourage irresponsible consumption. Users must comply with local laws. Minors may not use the platform except where permitted by law and only with authorization and supervision of a legal guardian.

Account, registration and security

Registration requirements depend on the channel you use:

• iOS native app: email, password and date of birth (18+) are required to create an account. Additional profile fields are optional and may be completed later on the Platform.
• Website and public signup: additional fields may be required, including full name, WhatsApp, identification document, address and other billing or compliance data.
• You agree to provide truthful and up-to-date information, protect your credentials and report unauthorized use of your account.
• You are responsible for all activities performed under your account.

License to use

AmphorApp grants a limited, non-exclusive, non-transferable, revocable and non-sublicensable license for personal use of the services. No intellectual property rights are transferred to the user.

Scanner and label recognition

The scanner uses proprietary and/or third-party technologies. AmphorApp does not guarantee identification of 100% of labels, absence of errors or permanent availability of references.

Results are informational and educational in nature and do not replace professional evaluation.

Cellar, inventory and vaults

Cellar, vault, inventory and valuation features are for informational purposes only.

You remain responsible for physical storage of beverages, inventory updates and data verification. AmphorApp is not liable for loss, theft, deterioration or misplacement.

Recommendations and artificial intelligence

Recommendations are generated by algorithms, statistical models and preferences provided by the user.

They do not constitute professional advice, satisfaction guarantees, financial advice or investment advice.

User content and photographs

You retain ownership of your content, granting AmphorApp a worldwide, non-exclusive license limited to what is necessary to store, display, index and process content to provide the service, including improvement of recognition algorithms.

You declare that you hold rights to submitted material and authorize processing of label photographs for cataloging.

WineCards, leagues and gamification

WineCards, WineWinner, leagues and competitions are recreational, educational and cultural in nature.

Use for betting, gambling, ranking manipulation, fraud or unauthorized commercial exploitation is prohibited.

Intellectual property

AmphorApp owns: software, interface, database, algorithms, Codex Vinorum, WineCards, trademarks and logos.

Full or partial reproduction without prior written authorization is prohibited.

Plans, subscriptions and payments

AmphorApp may offer Free, Basic, Standard, Master, Full and other plans, with bottle limits, features and prices subject to change with prior notice.

Subscription signup and renewal are made exclusively through the official stores: Apple App Store (iOS) and Google Play (Android). There is no external or website checkout: AmphorApp does not sell, renew or bill subscriptions on its website and does not process or store card or PIX data.

On iOS, payment, renewal and cancellation follow Apple In-App Purchase and Apple ID rules, including any introductory or promotional period offered. Manage or cancel in Apple ID / App Store settings.

On the current Android (Google Play) build, there are no in-app subscription purchases via Google Play Billing. AmphorApp never contracts or renews subscriptions on the website and does not process or store card or PIX data on Android either.

Your plan is tied to your AmphorApp account (not the device): after purchase in the respective store, entitlements sync across iOS, Android and the web according to the active entitlement.

Sponsored dependents

Eligible plan holders may invite dependents by sharing plan capacity (10% per dependent, deducted from the host quota) after explicitly accepting the capacity share.

Each invite uses a unique single-use code valid for 7 days to complete full registration. The host may revoke at any time. Transferring a dependent to another host is not allowed.

Each dependent has their own account and cellar. There is no cross-access to cellars (not even viewing). Only the stipulated limits are shared.

If the host downgrades and has more dependents than the new slot limit: the host must remove guests; after 7 days without regularization, the most recent excess guests are cut automatically. Affected users are notified to purchase their own plan to keep their data.

If a dependent's inventory exceeds their plan limit after migration or loss of sponsorship, the cellar remains visible and allows booking out items, but new additions are blocked until under the limit or an upgrade is purchased.

Privacy and data protection

Personal data processing complies with applicable law, including Brazil’s LGPD (Law No. 13,709/2018), the Marco Civil da Internet and other relevant regulations.

Availability and limitation of liability

We make reasonable efforts to keep the Platform available, without guaranteeing uninterrupted or error-free operation.

To the maximum extent permitted by law, AmphorApp is not liable for data loss due to user failure, temporary unavailability, purchase decisions based on recommendations, loss of collection value or indirect damages.

Child safety standards

AmphorApp is an adults-only platform (18+) for wine, spirits and collectible beverage management, education and curation. It is not directed at children and does not knowingly collect personal data from children.

The Platform does not provide open messaging, chat or free-form content sharing between users. User-to-user interaction is limited to structured features such as league rankings, game invitations (WineCards) and shared collection statistics.

AmphorApp has zero tolerance for child sexual abuse and exploitation (CSAE) in any form, on the Platform or otherwise. Any account found to violate this standard will be permanently terminated.

To report a concern related to child safety, including suspected CSAE content or behavior connected to the Platform, contact [email protected] or [email protected]. Reports are reviewed promptly and, where appropriate, forwarded to the relevant national or international child protection authorities and law enforcement.

Termination, changes and governing law

You may permanently delete your account at any time through Profile → Delete account (confirm email and password), or by contacting [email protected]. Deletion removes your account, cellar data and associated content, subject to legal retention obligations.

We may suspend or terminate accounts that violate these Terms, commit fraud or harm the Platform.

These Terms may be updated periodically; material changes will be communicated on the Platform. New registrations may require acceptance of the updated version.

The laws of the Federative Republic of Brazil apply. Venue: District of Bofete/SP, except for mandatory consumer jurisdiction.
